Planning Applications


The Planning Act encourages public bodies, such as municipalities and the Ontario Land Tribunal, to attempt to resolve planning disputes through mediation or other dispute resolution techniques. Private parties, such as developers, builders, and community associations can also use alternate dispute resolution to resolve differences, whether or not they are  within the jurisdiction of the OLT. Ron has successfully participated in dispute resolution in a wide range of planning disputes, including competing high-rise applications abutting residential neighbourhoods, and cost allocation between competing landowners.

Construction Contracts

The Construction Act now allows any party to a construction contract in Ontario, including a contractor, sub-contractor, commercial owner or homeowner, to refer a dispute concerning payment or the quality of services or goods provided. Other legislation warrants the quality of new homes. Ron is a certified adjudicator under ODACC, and has adjudicated the values of commercial and residential projects. He has also arbitrated numerous disputes between homebuilders and Tarion under the Builder Arbitration Forum.

Expropriation & Land Valuation

The increasing demand for housing, and the provision of roads, public transit, schools and parks to serve residential communities, has led to an increase in expropriation applications. Ron has assisted a number of clients to negotiate reasonable compensation, without the delay of a formal expropriation hearing.

If the use of lands in Ontario is changed to residential or institutional use, a landowner must meet stringent remediation standards. Ron Kanter has experience with former landfill sites, brownfield sites and leaks. Ron has also advised governments, applicants and neighbours on the appropriate balance between development and the retention of trees.

Municipal Governance & Service Provision

Rapid population growth and financial pressures are encouraging some municipalities to consider new governance arrangements and service agreements. Ron has facilitated discussions between an upper and lower-tier municipalities concerning governance, and is familiar with intermunicipal service agreements.

Payments in Lieu of Taxes (PILTs)

Properties owned by the provincial or federal government are exempt from municipal taxation in Ontario. However, the provincial or federal government must make payments in lieu of property taxes. Ron has experience determining the basis for PILTs for federal properties in Ontario.
